Mo Sethi and Lucy Bone respond to Law Commission Consultation on Employment Law Hearing Structures

Mo Sethi (ELBA Secretary) and Lucy Bone, together with leading members of the Employment Law Bar Association, prepared a comprehensive response to the Law Commission Consultation Paper No 239 on Employment Law Hearing Structures. Their response:

  • examines the jurisdictions of the ETs, EAT and the civil courts, including the jurisdictional boundaries between them, areas of shared and exclusive jurisdiction, restrictions on ETs’ jurisdiction, and the handling of employment cases in civil courts; 
  • assesses the extent to which the current system could be improved; and
  • makes a number of proposals for reform.

The Law Commission will now decide on its final recommendations and present them to Government.
