David Reade QC succeeds in argument on incompatibility under the Human Rights Act

Judgment on an application for judicial review of the CAC.  Mr Justice Keith
rejected the
Pharmacists’ Defence Association
Union’s (PDAU) application for a declaration of incompatibility under the Human
Rights Act against the trade union
recognition scheme under Schedule A1 Schedule of TULR(C)A 1992. The Judgment followed further argument on the
consequences of the earlier Judgment that the CAC exceeded its powers in reading words into Paragraph 35 of Schedule
A1.  The case concerns an application for recognition under Schedule A1 of that
Act brought by the Pharmacists’ Defence Association Union (PDAU) against
Boots.  David acted for Boots.
